Purchase of Residential Property

When purchasing residential property, there are typically three main stages involved: pre-purchase investigations, contract exchange, and settlement. The goal of the conveyancing process is to ensure that the new owner acquires a clear title, has knowledge of any registered interests on the property (such as easements or rights of way), is content with its designated use, and understands the condition of any buildings. Achieving these objectives involves conducting thorough searches and inquiries both before and after the exchange of contracts. Additionally, it is important to address stamp duty and GST considerations during this process.

Thinking about purchasing Property in NSW Off the Plan? 

Buying off the plan in NSW involves purchasing a property that has not yet been built or land, the plan for which has not yet been registered with NSW Land Registry Services. An off the plan purchase may not settle for two to three years after negotiations.

Most of the time, off the plan contracts of sale are lengthy and contain many special conditions and variables such as a series of completion dates/sunset clauses, providing a buffer to allow vendors additional time to finish the project and complete the contract. The contract also allows for variations in design, size and finishes subject to permissible limits.

Once the development is completed and the plan is registered, notice is given to the purchasers and settlement will usually have to occur in approximately 14 days. 

It is important you are advised of the off the plan contract of sale adequately to ensure you know exactly what you are getting yourself into and to know your rights and obligations under the contract.
